Why is spontaneity so important?

Fair Use assumes that the decision to use copyrighted material occurred too late to request permission to copy. Therefore, a teacher can use materials once under Fair Use. In order to use those same materials again, the teacher must pursue permisson or purchase.


Spontaneity and curriculum writing
  • Curriculum-writing teams may not assume that they have the same rights to materials as an individual classroom teacher.
  • Fair Use only applies in an individual teaching situation, not in any instructional activity/publication that has an audience beyond a single classroom.
